बीकानेर। बीकानेर की एसीजेएम (अपर मुख्य न्यायिक मजिस्ट्रेट) कोर्ट ने 2014 के बहुचर्चित हुसैन खां हत्याकांड में सभी आरोपियों को संदेह का लाभ देते हुए बरी कर दिया है। इस फैसले के बाद पीड़ित परिवार ने न्याय प्रक्रिया पर सवाल उठाए हैं और उच्च न्यायालय में अपील करने की बात कही है।

क्या था पूरा मामला?

यह हत्याकांड 1 मार्च 2014 को बीकानेर के सदर थाना क्षेत्र में होटल मेघसर केस्टल के पास हुआ था। मोहल्ला पंजाबगिरान निवासी हुसैन खां पर घात लगाकर हथियारों से लैस हमलावरों ने तलवारों से हमला कर दिया था, जिससे उसकी मौके पर ही मौत हो गई थी। इस वारदात के पीछे आपसी रंजिश बताई जा रही थी।

मुकदमे की कानूनी लड़ाई

हुसैन खां के भाई मोहम्मद रफीक की शिकायत पर पुलिस ने उस्मान, खालिद, परवेज, रशीद उर्फ लाला, सोनू पुत्रगण उस्मान, नवाब, जफर, बाबूलाल आचार्य सहित 4-5 अन्य लोगों के खिलाफ हत्या का मुकदमा दर्ज किया था। पुलिस ने अपनी जांच में आरोपियों को नामजद कर अदालत में चार्जशीट दाखिल की थी।

अदालत का फैसला

करीब 11 वर्षों तक चले इस मुकदमे के दौरान बचाव पक्ष ने तर्क दिया कि अभियोजन पक्ष ठोस सबूत पेश करने में असफल रहा है। न्यायालय ने दोनों पक्षों की दलीलें सुनने के बाद सभी आरोपियों को संदेह का लाभ देते हुए बरी कर दिया।

पीड़ित परिवार की प्रतिक्रिया

इस फैसले से मृतक के परिजनों में आक्रोश है। हुसैन खां के भाई मोहम्मद रफीक ने कहा कि वे इस फैसले से संतुष्ट नहीं हैं और जल्द ही उच्च न्यायालय में अपील करेंगे। वहीं, अभियोजन पक्ष का भी कहना है कि पर्याप्त सबूत न होने के कारण यह निर्णय आया, लेकिन आगे की कानूनी प्रक्रिया में वे पूरा प्रयास करेंगे।

समाज में प्रतिक्रिया

इस हत्याकांड को लेकर बीकानेर के स्थानीय समाज में भी कई तरह की चर्चाएं हो रही हैं। कुछ लोगों का मानना है कि पुलिस जांच में खामियां थीं, जिसके चलते आरोपियों को बरी कर दिया गया, जबकि कुछ का कहना है कि फैसला कानून के अनुसार हुआ है।

On March 1, 2014, in the Sadar police station area near Hotel Meghsar Castle, Hussain Khan, a resident of Punjabgiran Mohalla, was attacked with swords by armed assailants. He succumbed to his injuries on the spot. The attack was reportedly due to a long-standing personal rivalry.

Legal Battle

Following the murder, the victim’s brother, Mohammad Rafiq, lodged an FIR naming Usman, Khalid, Parvez, Rashid alias Lala, Sonu (sons of Usman), Nawab, Zafar, Babulal Acharya, and 4-5 unidentified persons as accused. The police filed a chargesheet against the accused based on their investigation.

Court’s Verdict

After nearly 11 years of legal proceedings, the defense argued that the prosecution failed to provide substantial evidence. The court, after hearing both sides, acquitted all accused, citing the benefit of the doubt.

Reaction from the Victim’s Family

The verdict has sparked outrage among the victim’s family. Mohammad Rafiq, brother of the deceased, stated that they are not satisfied with the decision and will appeal to the High Court. The prosecution also acknowledged the lack of strong evidence and expressed their intent to continue the legal battle.
