Directorate of Enforcement (ED) has taken possession of an immovable. property having registry value of Rs. 23.10 Lakh (Present market value : Rs. 5 Crore) of Late Pawan Kumar Singh, erstwhile director of M/s Classic Coal Construction Pvt, Ltd., situated at Mauza-Bariatu Booty Road, Ranchi in the case of bitumen coal scam of Jharkhand. In this case, ED had earlier attached properties worth Rs. 3.91 Crore by issuing two Provisional Attachment Orders under Prevention of Money Laundering Act, 2002 (PMLA), which were duly confirmed by the Adjudicating Authority under PMLA.
ED initiated investigation on the basis of four FIRS and charge sheets filed by ACB, CBI, Ranchi against M/s Classic Coal Constructions Pvt. Ltd., Pawan Kumar Singh (since expired), the erstwhile Managing Director of M/s Classic Coal Constructions, Dilip Kumar Singh, another Director of M/s Classic Coal Construction Pvt. Ltd., twenty-two Engineers of Road Construction Department, Govt. of Jharkhand and two others, for the offences of cheating and criminal misconduct. The company was mandated to procure bitumen from the Govt. undertaking oil companies viz. HPCL, IOCL, BPCL, etc., which was not done. In sheer violation of legal procedure, the directors of the company submitted 492 fake/forged invoices pertaining to HPCL, Ramnagar, West Bengal, to the Road Construction Department,showing procurement of 4630 MT of bitumen for road works and got payment in connivance with the departmental engineers on the strength of these fake/forged bills to the tune of Rs. 6.88 Crore. Investigation under PMLA revealed that this ill-gotten money was used to create assets and to meet miscellaneous expenditure pertaining to the company and its directors.
Two Prosecution Complaints against the firms and their Directors were filed on 31.03.2018 and 24.11.2020 respectively before the Special Court, PMLA, Ranchi, wherein the trial is under progress.
