“Governance Cannot Be Run from Jail” – Union Law Minister Arjun Ram Meghwal Defends 130th Constitutional Amendment, Slams Congress Over Attacks on Election Commission

Union Law and Justice Minister Arjun Ram Meghwal on Saturday made a forceful intervention in the ongoing national political discourse by strongly defending the 130th Constitutional Amendment and accusing the Congress party of deliberately attempting to malign democratic institutions such as the Election Commission of India (ECI).
Addressing a press conference in his home turf Bikaner, Meghwal minced no words: “A person sitting in jail cannot govern a nation. There is no place for corruption and dishonesty in a democracy.” His remarks, laced with political sharpness, came at a time when the opposition has been questioning the impartiality of constitutional authorities, while the government is pushing ahead with reforms aimed at strengthening accountability.
The 130th Constitutional Amendment: A Turning Point in Political Accountability
The amendment, recently passed in Parliament, lays down clear disqualification provisions for ministers and even the Prime Minister if they remain in jail for serious offences.
According to the provisions:
- Any Union Minister convicted or facing charges of an offence with five years or more punishment and who remains in jail continuously for 30 days, will be removed from office by the President on the advice of the Prime Minister.
- If the Prime Minister does not act, the minister will be automatically disqualified on the 31st day.
- If the Prime Minister himself is in jail under similar charges, he must resign within 30 days, failing which his post will also automatically cease on the 31st day.
The underlying philosophy, as Meghwal emphasized, is rooted in democratic morality: “It is against the very spirit of democracy that someone governing the country is simultaneously serving time in jail. India’s Constitution does not permit such contradictions.”
Congress vs Election Commission: A Political Flashpoint
Meghwal also targeted Congress leader Rahul Gandhi, recalling his statements on alleged “fake voters” and “stolen votes” in Maharashtra Assembly. He pointed out that the Election Commission immediately conducted a Special Summary Revision of Bihar’s electoral rolls to ensure transparency.
“Instead of appreciating corrective mechanisms, Congress continues to attack the Commission. This is nothing but an attempt to discredit an independent institution,” Meghwal remarked.
He further reminded journalists that during Balram Jakhar’s tenure as Lok Sabha Speaker, it was agreed that the functioning of the Election Commission would not be debated in a manner that questions its credibility. The minister accused Congress of breaking this tradition for short-term political mileage.
Vice Presidential Election: Ideologies at Clash
Speaking on the upcoming Vice Presidential election, Meghwal said that the contest is not merely between individuals but between two ideologies. He noted that the opposition-backed candidate B. Sudarshan Reddy has himself admitted his ideological association with the Left-Liberal school of thought, while the NDA’s nominee C. Radhakrishnan is shaped by the RSS school of ideology.
“This ideological clarity leaves no room for confusion. The choice is between two distinct philosophies,” Meghwal said, underscoring the BJP’s campaign line.
Election Commission’s Track Record Since 1952
The Union Minister strongly defended the Election Commission, arguing that since India’s first general election in 1952, the ECI has been a pillar of democratic governance. He reminded that over the decades, the Commission has constantly upgraded its systems — from ballot boxes to Electronic Voting Machines (EVMs) and now VVPATs — ensuring higher transparency.
Meghwal argued that Congress’ persistent allegations undermine public faith: “By attacking the Election Commission, the Congress is not just insulting an institution, it is insulting the will of the people of India.”
Historical Context: Disqualification and Constitutional Amendments
This amendment is being compared to earlier landmark changes in the Constitution — such as the 44th Amendment (1978) which curbed misuse of emergency powers, and the 91st Amendment (2003) that barred defectors from holding ministerial posts.
Experts note that the 130th Amendment strengthens the principle of “clean politics” by ensuring that leaders facing serious criminal charges cannot cling to power while in custody.
Meghwal’s remarks are seen as a direct rebuttal to opposition narratives that accuse the government of using constitutional changes for political advantage. Instead, the minister presented the amendment as an instrument of reform and accountability.

केंद्रीय कानून एवं न्याय मंत्री अर्जुनराम मेघवाल ने शनिवार को बीकानेर में प्रेस वार्ता कर 130वें संविधान संशोधन, निर्वाचन आयोग की साख और उपराष्ट्रपति चुनाव पर बड़ा बयान दिया। उन्होंने कांग्रेस पार्टी पर संवैधानिक संस्थाओं को बदनाम करने का आरोप लगाते हुए कहा – “लोकतंत्र में भ्रष्टाचार और बेईमानी की कोई जगह नहीं है। जेल में बैठा व्यक्ति देश का शासन नहीं चला सकता।”
130वां संविधान संशोधन – राजनीतिक जवाबदेही की नई कसौटी
हाल ही में संसद से पारित इस संशोधन के अनुसार –
- कोई भी केंद्रीय मंत्री यदि पांच साल या उससे अधिक की सजा वाले गंभीर अपराध में लगातार 30 दिन जेल में रहता है, तो राष्ट्रपति प्रधानमंत्री की सलाह पर उसे पद से हटा देंगे।
- यदि प्रधानमंत्री ऐसा नहीं करते तो 31वें दिन से मंत्री स्वतः पदमुक्त हो जाएगा।
- यही नियम प्रधानमंत्री पर भी लागू होगा। अगर प्रधानमंत्री खुद ऐसे अपराध में जेल में रहते हैं तो उन्हें 30 दिनों में इस्तीफा देना होगा, अन्यथा उनका पद स्वतः समाप्त हो जाएगा।
मेघवाल ने कहा – “यह लोकतंत्र की आत्मा के खिलाफ है कि कोई व्यक्ति जेल में बैठकर देश की सरकार चलाए। संविधान ऐसी स्थिति की अनुमति नहीं देता।”
कांग्रेस बनाम निर्वाचन आयोग – जारी टकराव
मेघवाल ने कांग्रेस नेता राहुल गांधी पर निशाना साधा और कहा कि उन्होंने महाराष्ट्र विधानसभा में फर्जी वोटर और वोट चोरी का मुद्दा उठाया। इसके बाद निर्वाचन आयोग ने तुरंत बिहार की वोटर लिस्ट का विशेष संक्षिप्त पुनरीक्षण शुरू किया।
उन्होंने कहा – “सुधार की प्रक्रिया चल रही है और ऐसे में आयोग पर उंगली उठाना उसकी साख को धूमिल करने की साजिश है।”
उन्होंने याद दिलाया कि बलराम जाखड़ के समय यह तय किया गया था कि चुनाव आयोग की कार्यप्रणाली पर ऐसी चर्चा नहीं होगी जिससे उसकी साख को ठेस पहुंचे।
उपराष्ट्रपति चुनाव – दो विचारधाराओं की जंग
मेघवाल ने आगामी उपराष्ट्रपति चुनाव को लेकर कहा कि यह मुकाबला केवल व्यक्तियों का नहीं बल्कि विचारधाराओं का है।
उन्होंने कहा कि विपक्ष के उम्मीदवार बी. सुदर्शन रेड्डी ने स्वयं स्वीकार किया है कि वे लेफ्ट-लिबरल विचारधारा से जुड़े हैं, जबकि एनडीए के प्रत्याशी सी. राधाकृष्णन आरएसएस विचारधारा से प्रभावित हैं।
मेघवाल के अनुसार, यह “विचारधारात्मक रूप से साफ मुकाबला है जिसमें कोई भ्रम की स्थिति नहीं है।”
1952 से अब तक निर्वाचन आयोग की भूमिका
केंद्रीय मंत्री ने जोर देकर कहा कि 1952 से लेकर अब तक भारत निर्वाचन आयोग ने हमेशा निष्पक्ष और पारदर्शी चुनाव कराए हैं।
उन्होंने कहा कि आयोग ने समय-समय पर सुधार किए — मतपेटियों से लेकर ईवीएम और वीवीपैट तक का सफर — जिससे जनता का भरोसा मजबूत हुआ है।
मेघवाल ने कहा – “कांग्रेस चुनाव आयोग पर हमला कर जनता की इच्छा का भी अपमान कर रही है।”
ऐतिहासिक संदर्भ – अयोग्यता और संशोधन
विशेषज्ञों के अनुसार, 130वां संशोधन उतना ही अहम है जितना 44वां संशोधन (1978) जिसने आपातकाल की शक्तियों पर अंकुश लगाया था, और 91वां संशोधन (2003) जिसने दलबदलुओं के मंत्री बनने पर रोक लगाई थी।
इस संशोधन से यह सुनिश्चित होगा कि गंभीर आपराधिक मामलों में जेल में बंद नेता सत्ता पर काबिज न रह सकें।
