The National Investigation Agency (NIA) has clarified that the absence of provisions of the Unlawful Activities (Prevention) Act (UAPA) from its latest chargesheet against American national Matthew Aaron Van Dyke and six Ukrainian nationals should not be interpreted as the closure or complete withdrawal of the terror-related investigation against the accused. According to sources, the NIA has filed the present chargesheet under provisions of the Immigration and Foreigners Act after establishing offences under that law during the investigation, while the investigation into possible offences under the UAPA continues. The development has assumed political and diplomatic significance because the case was initially registered under Section 18 of the UAPA and involved allegations relating to illegal entry into Myanmar and the provision of drone-warfare training to ethnic armed groups.

NIA Files Chargesheet Against Seven Accused, But UAPA Investigation Continues

The NIA recently filed a chargesheet before the Rouse Avenue Court in New Delhi against Van Dyke and six Ukrainian nationals in a case registered by the agency in March 2026. The case had initially been registered under the UAPA along with other provisions, placing the allegations in the category of offences that could potentially have national-security and terrorism-related implications. However, the chargesheet presently filed before the court invokes Sections 21 and 23 of the Foreigners Act rather than the UAPA provisions. The NIA’s Special Public Prosecutor has also indicated before the court that the investigation remains in progress and that the agency retains the option of filing a supplementary chargesheet if the ongoing investigation establishes an offence under the UAPA. This distinction is central to understanding the present legal position. The current chargesheet deals with offences that investigators say have already been established, while the broader investigation into other allegations remains underway. Therefore, the filing of the present chargesheet should not automatically be understood as a final judicial or investigative conclusion on every allegation originally included in the case.

Why the Absence of UAPA Provisions Has Become a Major Issue

The controversy surrounding the chargesheet largely stems from the fact that the case was originally registered under Section 18 of the UAPA, which concerns conspiracy to commit or attempt to commit a terrorist act. Once the NIA filed a chargesheet that did not contain the UAPA provisions, questions naturally emerged regarding whether the agency had found insufficient evidence to sustain the terrorism-related allegations. The issue became even more politically sensitive because Van Dyke is an American citizen, and the case has attracted attention from his family as well as U.S. diplomatic representatives.

Sources, however, have stressed that the present chargesheet should be viewed in the context of the statutory investigation timeline. According to the information shared by sources, the applicable period of 180 days of judicial custody in the case was approaching its expiry on September 8. Under the UAPA framework, the investigating agency can, subject to the statutory process and relevant judicial approval, have an extended period of up to 180 days to complete its investigation. If the applicable period expires without the requisite chargesheet, an accused may become entitled to seek statutory or default bail. The NIA therefore proceeded with filing the chargesheet for offences that it says had already been established under the Immigration and Foreigners Act rather than allowing the statutory period to lapse.

Foreigners Act Offences Were Already Established During Investigation

According to sources, the investigation had by this stage established offences under the Immigration and Foreigners Act against Van Dyke and the six Ukrainian nationals. The agency therefore filed the present chargesheet under Sections 21 and 23 of the Foreigners Act. This approach, sources said, was adopted to place before the court the offences that had already been established during the investigation while allowing the larger investigation to continue.

The legal significance of this distinction is considerable. A chargesheet is not necessarily the end of every investigative process in a case. Investigating agencies can, where permitted by law, continue investigating other aspects of a case after filing a chargesheet and subsequently submit a supplementary chargesheet if additional evidence emerges. In the present case, sources have specifically stated that the UAPA investigation remains active. Consequently, the absence of UAPA sections from the current chargesheet does not by itself establish that the allegations under the anti-terror law have been rejected, withdrawn or permanently abandoned.

The 180-Day Custody Timeline and Why the NIA Moved Before September 8

One of the most important factors behind the timing of the chargesheet is understood to be the statutory custody period. Van Dyke and the other accused were arrested in March 2026. As the investigation progressed, the 180-day period applicable under the UAPA framework was nearing completion on September 8. Sources say that the NIA had already established the alleged violations under the Immigration and Foreigners Act. This is why sources have urged against interpreting the latest filing as an indication that the NIA has suddenly concluded that no terrorism-related offence could ever be established.

The development therefore represents an important distinction between the offences currently chargesheeted and the entire investigation originally initiated by the agency. The two should not automatically be treated as identical.

What the NIA’s Present Position Means Legally

The NIA’s present position, as conveyed by sources and reflected in the court proceedings, is that the investigation has not reached its final conclusion on the UAPA aspect. The agency has filed charges under the Foreigners Act because those offences have been established during the investigation, while continuing to examine whether the evidence ultimately supports invocation of the UAPA provisions.

If investigators obtain additional material that establishes an offence under the UAPA, the agency can place that material before the court through the legally permissible process, including a supplementary chargesheet. Such a development would potentially change the legal position of the accused in relation to the terrorism-related allegations.

At the same time, it is important to distinguish an ongoing investigation from a finding of guilt. The fact that the NIA is continuing to investigate UAPA offences does not itself establish that Van Dyke or any of the other accused are guilty. Similarly, the filing of the Foreigners Act chargesheet represents the agency’s allegations based on the evidence it says it has gathered; the ultimate determination of guilt or innocence remains with the competent court.

Who Is Matthew Van Dyke and Why Has His Case Drawn Attention?

Matthew Aaron Van Dyke, an American national, was arrested along with six Ukrainian nationals in March 2026 in connection with the case registered by the NIA. The allegations surrounding the case have focused on illegal entry into Myanmar and alleged activities involving drone-warfare training of ethnic armed groups. Because drone warfare has become an increasingly important component of modern conflict, allegations involving training in unmanned aerial warfare have attracted particular attention from national-security observers.

The case also carries an international dimension because Van Dyke is a U.S. citizen. His detention has consequently become a matter of interest for U.S. diplomatic authorities, while Indian investigators continue to examine the allegations against him and the other accused.

The precise outcome of the UAPA investigation will depend on the evidence collected by the agency and the legal conclusions ultimately placed before the court. U.S. Diplomatic Intervention: Sources Call It Normal Consular Practice

Another important element of the controversy concerns U.S. diplomatic engagement over Van Dyke’s detention. Sources have stressed that the raising of the case by U.S. diplomats should not automatically be interpreted as political pressure on the Indian investigative process. They described diplomatic engagement over the detention of a foreign national as a normal part of consular practice.

India itself routinely seeks consular access and assistance when Indian citizens are detained or arrested abroad. Indian diplomatic missions can approach the authorities of the concerned country regarding consular access, legal assistance, fair treatment and other issues permitted under international and domestic law. Consular access to detained nationals is also recognised within the framework of the Vienna Convention on Consular Relations.

Against this background, U.S. officials raising the case of an American citizen in Indian custody is not, by itself, unusual. The more sensitive question is whether such diplomatic engagement has any bearing on the Indian investigative or prosecutorial process. On that issue, the available position from sources is that the UAPA investigation remains ongoing and that the present chargesheet should not be interpreted as evidence that terrorism-related allegations were dropped because of diplomatic intervention.

Van Dyke Family Appeals to U.S. Government for His Release

The case gained additional attention after an X account purportedly operated by Van Dyke’s family appealed to the U.S. Government for diplomatic intervention. On September 2, the account sought urgent intervention, alleging that Van Dyke was being denied basic detainee rights and was being held in solitary confinement at Tihar Jail in Delhi. The family maintained that Van Dyke was innocent and described his previous work as involving documentation of human suffering and humanitarian assistance to people affected by conflicts and crises.

The family’s position represents the defence-side narrative surrounding the case. However, the allegations made by the family do not determine the legal status of the proceedings. Those claims will ultimately have to be assessed through the appropriate legal and judicial processes.

The NIA, meanwhile, has maintained that the investigation is continuing. Sources have specifically stated that the Foreigners Act chargesheet does not mean that the agency has closed the UAPA investigation against Van Dyke or the other six accused.

Congress Questions the Government Over the Chargesheet

The latest development has also triggered a political response. Congress MP and senior Supreme Court advocate Abhishek Manu Singhvi questioned the omission of UAPA provisions from the current chargesheet. Singhvi said that if reports were correct that terrorism charges against Van Dyke had been dropped following high-level U.S.-India meetings, the Modi Government owed an explanation to the country.

Singhvi also questioned how allegations involving illegal entry, links with armed groups and drone-warfare training could apparently disappear from the chargesheet. His comments have added a political dimension to an already sensitive case involving national security, counter-terrorism legislation and diplomatic relations between India and the United States.

However, the NIA-linked clarification provides a different interpretation. According to sources, the terror investigation has not been dropped, and the agency is still examining the UAPA aspect. The immediate chargesheet has instead been filed for the Immigration and Foreigners Act offences that investigators say were already established.

Political Allegations Versus the Investigative Position

The central dispute can therefore be reduced to two competing interpretations of the same development. The political criticism focuses on the fact that the NIA originally registered the case under the UAPA but has now filed a chargesheet without those provisions. From this perspective, questions naturally arise over whether the terrorism-related allegations were weakened, withdrawn or influenced by diplomatic considerations.

The allegations in this case reportedly concern training involving ethnic armed groups in Myanmar. However, the allegations remain allegations unless and until established through the judicial process. The ongoing NIA investigation will determine whether the available evidence supports charges under the UAPA or other applicable laws.

The Van Dyke case has consequently evolved into a complex intersection of counter-terrorism law, immigration law, international diplomacy and emerging military technology. On one side is the NIA’s national-security investigation into allegations involving foreign nationals, Myanmar-based armed groups and drone-warfare training. On the other is the diplomatic and consular dimension arising from the detention of an American citizen.

The latest chargesheet has added another layer because the agency has proceeded under the Foreigners Act while keeping the UAPA investigation open. For observers, the coming stages of the investigation will therefore be critical. Any supplementary chargesheet, additional evidence or court order concerning the UAPA allegations could significantly alter the legal and political narrative surrounding the case.

What Happens Next in the Case

The immediate legal proceedings will revolve around the offences invoked in the present chargesheet. Meanwhile, the NIA’s investigation into the UAPA aspect is expected to continue. The agency may submit additional material to the court if its investigation establishes further offences.

The case therefore remains open from the perspective of the larger investigation. The current chargesheet should not be portrayed as either a clean acquittal of the accused or a judicial rejection of the terrorism allegations. Neither has occurred at this stage.

Similarly, the political claims surrounding alleged diplomatic influence remain matters of political debate unless supported by evidence. The official investigative position conveyed by sources is that the UAPA investigation continues and that the current chargesheet was filed because the Immigration and Foreigners Act offences had already been established before the statutory custody period expired.

The Larger National-Security Question

Beyond the immediate legal controversy, the case raises a broader question about how India deals with foreign nationals allegedly involved in conflict zones, armed groups and advanced military technologies. The increasing availability of commercial drones, sophisticated navigation systems, autonomous capabilities and battlefield software has blurred the traditional distinction between civilian technology and military capability.

For Indian security agencies, cases involving foreign nationals and alleged training of armed groups therefore carry implications that extend beyond immigration violations. At the same time, the legal process requires investigators to establish each offence through admissible evidence and requires courts to determine guilt according to law.

The Van Dyke case is consequently likely to remain under scrutiny from India’s security establishment, diplomatic community, legal experts and political parties until the NIA completes its investigation and the courts consider the evidence.

Bottom Line: UAPA Not Invoked in Current Chargesheet, But Investigation Has Not Been Closed

The most important takeaway from the latest development is that the NIA’s current chargesheet does not invoke the UAPA, but according to sources, the agency has not dropped or closed the UAPA investigation against Matthew Van Dyke and the six Ukrainian nationals. The present chargesheet has been filed under the Immigration and Foreigners Act because the agency says those offences had already been established during the investigation and the 180-day statutory custody period was approaching its deadline.

अमेरिकी नागरिक मैथ्यू आरोन वैन डाइक और छह यूक्रेनी नागरिकों के खिलाफ राष्ट्रीय जांच एजेंसी यानी NIA की ओर से दाखिल की गई ताजा चार्जशीट को लेकर उठ रहे सवालों के बीच जांच से जुड़े सूत्रों ने महत्वपूर्ण स्पष्टीकरण दिया है। सूत्रों के मुताबिक, मौजूदा चार्जशीट में गैरकानूनी गतिविधियां रोकथाम अधिनियम यानी UAPA की धाराएं शामिल नहीं होने का यह मतलब बिल्कुल नहीं है कि NIA ने आतंकवाद से जुड़े आरोपों की जांच पूरी तरह खत्म कर दी है। सूत्रों का कहना है कि UAPA के तहत जांच अभी भी सभी सात आरोपियों के खिलाफ जारी है और यदि आगे की जांच में UAPA के तहत अपराध के पर्याप्त साक्ष्य सामने आते हैं, तो NIA सप्लीमेंट्री चार्जशीट दाखिल कर सकती है।

NIA ने मंगलवार को दिल्ली की राउज एवेन्यू कोर्ट के समक्ष मैथ्यू वैन डाइक समेत छह यूक्रेनी नागरिकों के खिलाफ चार्जशीट दाखिल की थी। यह मामला मार्च 2026 में NIA द्वारा दर्ज किया गया था और शुरुआत में इसमें UAPA की धारा 18 समेत अन्य धाराएं लगाई गई थीं। लेकिन मौजूदा चार्जशीट में UAPA की धाराएं शामिल नहीं की गईं और एजेंसी ने इमिग्रेशन एंड फॉरेनर्स एक्ट यानी विदेशियों से संबंधित कानून के तहत धाराएं 21 और 23 लगाई हैं। इसी वजह से यह सवाल उठा कि क्या NIA ने आतंकवाद से जुड़े आरोपों को छोड़ दिया है। हालांकि, सूत्रों ने स्पष्ट किया है कि ऐसा निष्कर्ष निकालना जल्दबाजी होगा।

मार्च में हुई थी गिरफ्तारी, मामला UAPA के तहत हुआ था दर्ज

मैथ्यू आरोन वैन डाइक और छह यूक्रेनी नागरिकों को मार्च 2026 में गिरफ्तार किया गया था। NIA ने यह मामला मूल रूप से UAPA की धारा 18 सहित अन्य प्रावधानों के तहत दर्ज किया था। जांच एजेंसी के आरोपों का संबंध म्यांमार में कथित अवैध प्रवेश और जातीय सशस्त्र समूहों को ड्रोन युद्ध यानी ड्रोन-वॉरफेयर से संबंधित प्रशिक्षण देने से था। इस कारण मामला केवल सामान्य इमिग्रेशन उल्लंघन तक सीमित नहीं था, बल्कि इसमें राष्ट्रीय सुरक्षा और आतंकवाद से जुड़े गंभीर पहलुओं की जांच भी की जा रही थी।

हालांकि अब दाखिल की गई चार्जशीट में UAPA की धाराएं नहीं हैं। यही बात राजनीतिक और कानूनी बहस का मुख्य कारण बनी। लेकिन NIA के विशेष लोक अभियोजक ने कोर्ट के सामने स्पष्ट किया कि जांच अभी पूरी नहीं हुई है और यदि जांच के दौरान UAPA के तहत अपराध बनता है तो एजेंसी आगे सप्लीमेंट्री चार्जशीट दाखिल कर सकती है।

UAPA हटना और UAPA जांच बंद होना दो अलग बातें हैं

इस पूरे मामले को समझने के लिए सबसे महत्वपूर्ण अंतर यह है कि किसी मौजूदा चार्जशीट में UAPA की धाराएं शामिल नहीं होना और UAPA के तहत पूरी जांच बंद कर देना एक ही बात नहीं है। NIA से जुड़े सूत्रों का कहना है कि वर्तमान चार्जशीट में उन अपराधों को शामिल किया गया है जिन्हें जांच के दौरान अब तक पूरी तरह स्थापित माना गया है। वहीं UAPA से संबंधित जांच अभी जारी है।

सूत्रों के मुताबिक, जांच एजेंसी ने यह फैसला इसलिए भी लिया क्योंकि आरोपी की 180 दिन की न्यायिक हिरासत की वैधानिक अवधि 8 सितंबर को समाप्त होने वाली थी। UAPA के तहत जांच के दौरान कुछ निर्धारित परिस्थितियों और कानूनी प्रक्रिया के अधीन जांच एजेंसी को 180 दिन तक का समय मिल सकता है। यदि लागू अवधि के भीतर आवश्यक चार्जशीट दाखिल नहीं होती है तो आरोपी को वैधानिक या डिफॉल्ट जमानत मांगने का अधिकार मिल सकता है।

इसी वजह से NIA ने उन अपराधों को लेकर चार्जशीट दाखिल की जिन्हें उसके अनुसार जांच में पहले ही स्थापित किया जा चुका था, जबकि बाकी जांच को जारी रखा गया।

Foreigners Act के तहत अपराध पहले ही स्थापित होने का दावा

सूत्रों के अनुसार, NIA की जांच में मैथ्यू वैन डाइक और अन्य आरोपियों के खिलाफ Immigration and Foreigners Act के तहत अपराधों के पर्याप्त तत्व पहले ही सामने आ चुके थे। इसलिए एजेंसी ने वर्तमान चरण में उन्हीं अपराधों के आधार पर चार्जशीट दाखिल की। इसका उद्देश्य यह था कि वैधानिक समय सीमा समाप्त होने से पहले स्थापित अपराधों को कोर्ट के सामने रखा जा सके।

लेकिन सूत्रों ने जोर देकर कहा कि इसे पूरे मामले की जांच समाप्त होने के रूप में नहीं देखा जाना चाहिए। यदि आगे की जांच में UAPA के तहत अपराध से संबंधित अतिरिक्त और पर्याप्त साक्ष्य मिलते हैं तो एजेंसी कानून के तहत आगे की कार्रवाई कर सकती है और सप्लीमेंट्री चार्जशीट दाखिल कर सकती है।

यानी इस समय मामला दो स्तरों पर आगे बढ़ रहा है। एक तरफ Foreigners Act से जुड़े अपराधों की चार्जशीट दाखिल हो चुकी है, वहीं दूसरी तरफ UAPA से जुड़े आरोपों की जांच अभी भी जारी है।

180 दिन की वैधानिक समय सीमा बनी अहम वजह

इस मामले में 180 दिन की समय सीमा बेहद महत्वपूर्ण है। मार्च 2026 में गिरफ्तार किए गए आरोपियों के मामले में सितंबर की शुरुआत तक यह अवधि अपने अंतिम चरण में पहुंच चुकी थी। सूत्रों के मुताबिक, मैथ्यू वैन डाइक के मामले में 180 दिन की न्यायिक हिरासत की अवधि 8 सितंबर को समाप्त होने वाली थी।

ऐसी स्थिति में जांच एजेंसी के सामने महत्वपूर्ण कानूनी चुनौती थी। यदि लागू वैधानिक समय सीमा के भीतर आवश्यक कार्रवाई नहीं होती, तो आरोपी वैधानिक जमानत का दावा कर सकता था। NIA ने इस स्थिति से बचने के लिए उन अपराधों को लेकर चार्जशीट दाखिल की जिन्हें जांच के दौरान स्थापित माना गया।

इसका मतलब यह नहीं है कि एजेंसी ने बाकी आरोपों को अंतिम रूप से खारिज कर दिया। बल्कि सूत्रों के मुताबिक, UAPA की जांच को जारी रखते हुए वर्तमान में स्थापित अपराधों की चार्जशीट दाखिल की गई है।

NIA की जांच में ड्रोन वॉरफेयर ट्रेनिंग का आरोप क्यों महत्वपूर्ण है

इस मामले का सबसे संवेदनशील पहलू ड्रोन-वॉरफेयर ट्रेनिंग से जुड़ा आरोप है। आधुनिक युद्ध में ड्रोन अब केवल निगरानी के उपकरण नहीं रह गए हैं। उनका इस्तेमाल टारगेटिंग, सर्विलांस, हथियार पहुंचाने, सटीक हमलों, इलेक्ट्रॉनिक वॉरफेयर और अन्य सैन्य भूमिकाओं में तेजी से बढ़ा है।

ऐसे समय में किसी सशस्त्र समूह को ड्रोन संचालन या ड्रोन युद्ध से संबंधित प्रशिक्षण दिए जाने के आरोप को सुरक्षा एजेंसियां गंभीरता से ले सकती हैं। NIA की जांच में म्यांमार और वहां सक्रिय जातीय सशस्त्र समूहों से जुड़े पहलुओं की भी जांच की जा रही है।

हालांकि, यह स्पष्ट करना जरूरी है कि जांच एजेंसी के आरोप अभी न्यायिक प्रक्रिया के अधीन हैं। किसी भी आरोपी को केवल आरोपों के आधार पर दोषी नहीं माना जा सकता। अपराध सिद्ध होने या न होने का अंतिम निर्णय न्यायालय द्वारा साक्ष्यों के आधार पर किया जाएगा।

अमेरिकी नागरिक होने के कारण मामला बना राजनयिक रूप से संवेदनशील

मैथ्यू वैन डाइक अमेरिकी नागरिक हैं। इसलिए उनकी गिरफ्तारी और हिरासत ने मामले को राजनयिक स्तर पर भी महत्वपूर्ण बना दिया है। अमेरिकी राजनयिक अधिकारियों की ओर से अपने नागरिक के मामले को उठाया जाना अब राजनीतिक बहस का विषय बन गया है।

हालांकि, जांच से जुड़े सूत्रों ने इसे सामान्य राजनयिक और कांसुलर प्रक्रिया बताया है। भारत भी जब किसी भारतीय नागरिक को विदेश में गिरफ्तार किया जाता है तो संबंधित देश के अधिकारियों के साथ कांसुलर एक्सेस, कानूनी सहायता, निष्पक्ष व्यवहार और अन्य अनुमत मुद्दों को लेकर संपर्क करता है।

इसी तरह किसी विदेशी नागरिक की भारत में गिरफ्तारी के बाद उसके देश के राजनयिक अधिकारियों द्वारा उसका मामला उठाया जाना अंतरराष्ट्रीय कांसुलर व्यवस्था का सामान्य हिस्सा है। इसलिए केवल अमेरिकी अधिकारियों द्वारा मामला उठाए जाने से यह निष्कर्ष निकालना उचित नहीं होगा कि भारतीय जांच एजेंसी की कार्रवाई पर किसी प्रकार का दबाव पड़ा।

मैथ्यू वैन डाइक के परिवार ने अमेरिकी सरकार से मांगी मदद

2 सितंबर को कथित तौर पर मैथ्यू वैन डाइक के परिवार द्वारा संचालित X अकाउंट से अमेरिकी सरकार से तत्काल राजनयिक हस्तक्षेप की अपील की गई थी। परिवार ने आरोप लगाया कि वैन डाइक को बुनियादी हिरासत अधिकारों से वंचित किया जा रहा है और उन्हें दिल्ली की तिहाड़ जेल में एकांत हिरासत में रखा गया है।

परिवार ने उन्हें निर्दोष बताते हुए कहा कि उन्होंने अपने करियर के दौरान युद्ध और संकट से प्रभावित लोगों की पीड़ा को दस्तावेज करने और मानवीय सहायता प्रदान करने का काम किया है। परिवार की ओर से अमेरिकी सरकार से उनकी रिहाई के लिए हस्तक्षेप की मांग की गई।

हालांकि परिवार के ये दावे मामले के बचाव पक्ष की स्थिति को दर्शाते हैं। इनके आधार पर आरोपी की कानूनी दोषसिद्धि या निर्दोषता तय नहीं होती। इसका अंतिम निर्धारण भारतीय न्यायिक प्रक्रिया में उपलब्ध साक्ष्यों के आधार पर होना है।

कांग्रेस सांसद अभिषेक मनु सिंघवी ने उठाए सवाल

मामले में राजनीतिक विवाद तब और बढ़ गया जब कांग्रेस सांसद और वरिष्ठ सुप्रीम कोर्ट अधिवक्ता अभिषेक मनु सिंघवी ने मौजूदा चार्जशीट में UAPA की धाराएं शामिल नहीं किए जाने पर सवाल उठाए।

सिंघवी ने कहा कि यदि ऐसी खबरें सही हैं कि अमेरिकी नागरिक मैथ्यू वैन डाइक के खिलाफ आतंकवाद से जुड़े आरोप भारत और अमेरिका के बीच उच्चस्तरीय बैठकों के बाद हटा दिए गए हैं, तो मोदी सरकार को देश को इसका स्पष्टीकरण देना चाहिए। उन्होंने सवाल उठाया कि यदि शुरुआत में अवैध प्रवेश, सशस्त्र समूहों से संबंध और ड्रोन वॉरफेयर ट्रेनिंग जैसे गंभीर आरोप थे, तो ये आरोप अचानक चार्जशीट से कैसे गायब हो गए।

सिंघवी के बयान ने मामले को राजनीतिक रंग दे दिया है। लेकिन इसके समानांतर NIA से जुड़े सूत्रों का कहना है कि UAPA जांच अभी बंद नहीं हुई है और मौजूदा चार्जशीट को पूरे मामले का अंतिम निष्कर्ष मानना सही नहीं होगा।

क्या अमेरिकी दबाव के कारण UAPA हटाया गया?

यही इस पूरे विवाद का सबसे बड़ा राजनीतिक सवाल बन गया है। विपक्षी पक्ष इस बात पर सवाल उठा रहा है कि क्या अमेरिकी नागरिक की गिरफ्तारी और उसके बाद हुई राजनयिक बातचीत का मौजूदा चार्जशीट पर कोई प्रभाव पड़ा है।

लेकिन सूत्रों का कहना है कि वर्तमान चार्जशीट को अमेरिकी राजनयिक हस्तक्षेप से जोड़ना उचित नहीं है। उनके मुताबिक, NIA ने Foreigners Act के तहत वे अपराध चार्जशीट किए हैं जो जांच में अब तक स्थापित हो चुके थे, जबकि UAPA से जुड़े आरोपों की जांच जारी है।

इसलिए फिलहाल उपलब्ध जानकारी के आधार पर यह कहना सही नहीं होगा कि NIA ने अमेरिकी दबाव में UAPA की जांच समाप्त कर दी है। इसके विपरीत, जांच से जुड़े सूत्रों का स्पष्ट कहना है कि सभी सात आरोपियों के खिलाफ UAPA से संबंधित जांच जारी है।

Supplementary Chargesheet अब बनेगी मामले की अगली बड़ी कड़ी

अब इस मामले में सबसे महत्वपूर्ण अगला कदम सप्लीमेंट्री चार्जशीट हो सकता है। यदि जांच के दौरान NIA को ऐसा अतिरिक्त साक्ष्य मिलता है जिससे UAPA के तहत अपराध स्थापित होता है, तो एजेंसी कानूनी प्रक्रिया के तहत आगे की कार्रवाई कर सकती है।

इस स्थिति में वर्तमान Foreigners Act चार्जशीट मामले का अंतिम अध्याय नहीं बल्कि जांच की एक अंतरिम कड़ी साबित हो सकती है। दूसरी ओर, यदि आगे की जांच में UAPA के आरोपों को समर्थन देने वाला पर्याप्त साक्ष्य नहीं मिलता, तो मामला मौजूदा आरोपों तक सीमित भी रह सकता है।

यही कारण है कि इस समय UAPA के आरोपों के भविष्य को लेकर अंतिम निष्कर्ष निकालना जल्दबाजी होगी।

कानूनी रूप से अभी क्या स्थिति है

मौजूदा स्थिति में NIA ने Foreigners Act के तहत आरोपों की चार्जशीट दाखिल की है। UAPA की धाराएं वर्तमान चार्जशीट में नहीं हैं। लेकिन NIA के अनुसार UAPA से संबंधित जांच जारी है।

इसका अर्थ यह भी नहीं है कि आरोपियों को UAPA से जुड़े मामले में अदालत ने बरी कर दिया है। ऐसी कोई अंतिम न्यायिक व्यवस्था अभी सामने नहीं आई है। इसी तरह NIA की ओर से लगाए गए आरोपों को भी तब तक दोषसिद्धि नहीं माना जा सकता जब तक अदालत में वे साबित न हों।

पूरे मामले का अंतिम कानूनी स्वरूप आगे की जांच, संभावित सप्लीमेंट्री चार्जशीट और न्यायालय के आदेशों पर निर्भर करेगा।

राष्ट्रीय सुरक्षा के नजरिए से मामला क्यों महत्वपूर्ण है

वैन डाइक मामला केवल एक विदेशी नागरिक की गिरफ्तारी तक सीमित नहीं है। इसके पीछे विदेशी नागरिकों, संघर्ष क्षेत्रों, सशस्त्र समूहों और आधुनिक सैन्य तकनीक के बीच बढ़ते संबंधों का बड़ा सवाल भी है।

ड्रोन तकनीक ने दुनिया भर में युद्ध की प्रकृति बदल दी है। रूस-यूक्रेन युद्ध से लेकर पश्चिम एशिया और अन्य संघर्ष क्षेत्रों तक ड्रोन का इस्तेमाल लगातार बढ़ा है। ऐसे में किसी विदेशी नागरिक या समूह द्वारा सशस्त्र संगठनों को ड्रोन युद्ध से जुड़ा प्रशिक्षण देने के आरोप राष्ट्रीय सुरक्षा एजेंसियों के लिए गंभीर चिंता का विषय बन सकते हैं।

भारत के लिए म्यांमार का भौगोलिक और सुरक्षा महत्व भी काफी बड़ा है। म्यांमार में सक्रिय विभिन्न सशस्त्र समूहों, सीमा सुरक्षा, हथियारों की तस्करी और पूर्वोत्तर भारत की सुरक्षा स्थिति के कारण वहां होने वाली किसी भी सैन्य या तकनीकी गतिविधि पर भारतीय सुरक्षा एजेंसियों की नजर रहती है।

इसी व्यापक सुरक्षा संदर्भ में NIA की जांच को देखा जा रहा है।

मामला अब कानून, राष्ट्रीय सुरक्षा और कूटनीति के बीच

मैथ्यू वैन डाइक का मामला अब कानून, राष्ट्रीय सुरक्षा और अंतरराष्ट्रीय कूटनीति के तीन महत्वपूर्ण पहलुओं के बीच खड़ा दिखाई दे रहा है। NIA एक ओर विदेशी नागरिकों और म्यांमार से जुड़े कथित गतिविधियों की जांच कर रही है, दूसरी ओर अमेरिकी नागरिक होने के कारण मामले में कांसुलर और राजनयिक पहलू भी मौजूद हैं।

मौजूदा चार्जशीट ने इस मामले को और जटिल बना दिया है क्योंकि Foreigners Act के तहत आरोप दाखिल किए गए हैं, लेकिन UAPA से संबंधित जांच जारी रखी गई है।

इसका अर्थ यह है कि अदालत के सामने फिलहाल एक तरह के अपराधों की चार्जशीट है, जबकि जांच एजेंसी दूसरे और अधिक गंभीर आरोपों की जांच अभी जारी रखे हुए है।

सबसे बड़ा निष्कर्ष: UAPA की धाराएं फिलहाल चार्जशीट में नहीं, लेकिन जांच खत्म नहीं हुई

पूरे मामले का सबसे महत्वपूर्ण निष्कर्ष यही है कि NIA की मौजूदा चार्जशीट में UAPA की धाराएं शामिल नहीं की गई हैं, लेकिन जांच से जुड़े सूत्रों के अनुसार UAPA की जांच समाप्त, वापस या बंद नहीं की गई है।

NIA ने Foreigners Act के तहत उन अपराधों की चार्जशीट दाखिल की है जिन्हें जांच में अब तक स्थापित माना गया है। यह कार्रवाई उस समय हुई जब 180 दिन की वैधानिक हिरासत अवधि समाप्त होने वाली थी। वहीं UAPA से जुड़े आरोपों की जांच अभी जारी है और यदि आगे पर्याप्त साक्ष्य सामने आते हैं तो NIA सप्लीमेंट्री चार्जशीट दाखिल कर सकती है।

इसलिए फिलहाल यह कहना कि “NIA ने आतंकवाद के आरोप पूरी तरह छोड़ दिए हैं”, उपलब्ध जानकारी के आधार पर सही तस्वीर नहीं होगी। वहीं यह भी कहना उचित नहीं होगा कि UAPA के आरोप साबित हो चुके हैं। वास्तविक स्थिति यह है कि Foreigners Act के तहत चार्जशीट दाखिल हो चुकी है, जबकि UAPA से संबंधित जांच अभी लंबित है।

आगे की जांच, संभावित सप्लीमेंट्री चार्जशीट और अदालत में सामने आने वाले साक्ष्य ही यह तय करेंगे कि मैथ्यू वैन डाइक और छह अन्य आरोपियों के खिलाफ UAPA के आरोप आगे किस दिशा में जाते हैं।
