JAMMU : Nikhil Padha (Human Rights Activist) and Adv. Naveed Bukhtiyar writes to Registrar Judicial of Apex
Court of India for Defamatory Statement Published on Social MediaAgainst the Judiciary and the CJI.
On 12th April 2022, Mr. Nikhil Padha, Human Rights Activist, Founder Hartal for Harmony and Adv. Naveed Bukhtiyar (Advocate, Jammu Kashmir and Ladakh High Court), decided to file a complaint against the Admin of an Instagram page named “sanghparivarorg”. The page describes itself as an independent initiative by swayamsevaks wherein it posts updates on the Rashtriya Swayamsevak Sangh (RSS). It has over 2 lakh 71 thousand followers and is widelyfollowed by the youth on Instagram.
In the matter, the admin of the page had passed deplorable and hurtful comments on the functioningof the judicial system under the current CJI’s supervision. The admin of the page by publishingand posting such highly scandalous, false and defamatory imputations against the Hon’ble CJI andthe Judiciary has tarnished and harmed its reputation and has affected its goodwill and publicimage. Such an act attracts penal consequences under sections 153-A, 499, 504, 505(2) of theIndian Penal Code, Criminal Contempt and under Section 2(c) of the Contempt of Courts Act,1971.
The right to freedom ofspeech is subjected to reasonable restrictions to safeguard thesanctity of an individual orinstitution from such defamatory and baseless statements taking originfrom a malicious intention.
As law-abiding citizens of India, it becomes our responsibility to hold such persons that attack thedignity and authority of the courts and judges accountable for their actions.
